This Privacy Policy explains how NightGuard (the “App”) collects, uses, stores, and shares your information. We value your privacy and are committed to complying with applicable laws, including GDPR and CCPA.
1. Introduction
- App Name: NightGuard — Sleep analysis and insights
- Purpose: Help users understand sleep trends and improve sleep quality.
- Commitment: We do not sell personal data, do not show third-party ads, and do not use third-party ad/analytics SDKs.
2. Information We Collect
We only collect data with your permission or when strictly necessary to provide the service.
2.1 Data You Provide
- Account: Basic identifiers provided by Sign in with Apple (e.g., Apple’s anonymous identifier).
- Feedback & Support: Any messages, screenshots, or contact details you send us.
- Subscription: Status of App Store purchases/subscriptions via system APIs.
2.2 Data Collected Automatically
- Device & App Info: Device model, OS version, app version, crash logs (if applicable, solely for diagnostics).
- Notification State: Whether you granted notification permission; push token if used.
- Local Caches: Temporary data to improve performance.
2.3 Health & Location (With Consent)
- HealthKit: Sleep analysis data (e.g., sleep stages, duration) and related health metrics (e.g., heart rate/HRV/respiratory rate), strictly per your authorization.
- Location: To provide local weather/context; you can change location permissions anytime in iOS settings.
3. How We Use Information
- Provide & Improve: Sleep insights, personalized suggestions, reminders/notifications.
- Sync & Backup: Securely sync via your iCloud/CloudKit account (if enabled).
- Support: Respond to your inquiries.
- Compliance & Security: Prevent abuse, maintain integrity.
- Not used for: Advertising, selling data, third-party profiling, or cross-app tracking.
4. Data Sharing and Disclosure
- Third-Party Ads/Analytics: None. We do not share with advertisers or analytics providers.
- Apple Services: We may use HealthKit, iCloud/CloudKit, Sign in with Apple, WeatherKit to deliver features.
- Service Providers: Limited sharing under contractual confidentiality for diagnostics or support emails only when necessary.

5. Data Storage and Security
- Where: On-device and/or in your iCloud (via CloudKit).
- Security: HTTPS in transit; sensitive data protected per platform best practices.
- Access Control: Least privilege and strictly need-to-know.
6. Your Rights
- Access/Rectification: View authorized data sources; adjust via iOS Health and system settings.
- Portability: Contact us to request a data export of available data.
- Deletion:
- Revoke Health permissions and delete health data in iOS Settings;
- Use in-app “Delete Account/Clear Data” (if available);
- Or email us to request deletion.
- Notifications/Location: You can adjust permissions anytime in iOS.
We typically respond to your request within 30 days. Before responding, we may need to reasonably verify your identity using information associated with your account or email to protect your data.
7. Children’s Privacy
The App is not directed to children under 13 and does not knowingly collect their personal information. We will delete such data if discovered.
8. Third-Party Services
- Apple HealthKit (used only with authorization for health/sleep features)
- iCloud/CloudKit (for sync/backup)
- Sign in with Apple (account sign-in/identity)
- WeatherKit or system weather (for local weather/context)
- App Store / StoreKit (in-app purchases/subscriptions)

9. Data Retention
We retain data only as long as necessary for the purposes described. You may revoke permissions or request deletion anytime; related features may become unavailable.
Example retention periods (adjustable as needed): crash logs ≤ 90 days (diagnostics only); support emails/tickets ≤ 24 months; local caches ≤ 7 days or cleared upon version updates; HealthKit and iCloud/CloudKit synced data are retained or deleted by you.
Current app configuration (for transparency):
- AI insights cache: 7 days (cleaned every 24 hours)
- Weather background cache: 1 day (cleaned every 1 hour)
- Query cache (incl. temporary sleep data and segments): 5 minutes
- UserDefaults lightweight cache: 30 days (cleaned every 7 days)
- Persisted sleep data JSON: files remain, but only entries not expired within 5 minutes are accepted at load time (effective validity 5 minutes)
10. International Transfers
Data may be transferred and stored across regions (e.g., iCloud/CloudKit regional data centers). We implement safeguards consistent with applicable laws (e.g., Standard Contractual Clauses).
11. GDPR Notice (EU/EEA)
- Role: We generally act as Data Controller.
- Legal Bases: Consent, Contract, Legitimate Interests (product improvement/security only).
- Rights: Access, rectification, erasure, restriction, objection, portability.
